These Terms are an agreement between you and Kane Personal Computer, Inc. (“Kane PC,” “we,” “us”), a New York corporation based in White Plains, New York, covering your use of Diamond Coach (the “Service”). By creating an account you accept them.
You must be 18 or older. Accounts are for coaches, assistant coaches, league administrators, and parents or guardians. Youth athletes may not create accounts.
Keep your credentials confidential and tell us promptly at coach@diamondcoach.app if you suspect unauthorized access. You are responsible for activity under your account. Invitations are bound to the email address they were sent to and cannot be redeemed by anyone else.
This is the most important obligation in these Terms.
The Service uses AI to suggest lineups, generate practice plans, and answer strategy questions. AI output is a suggestion, not a decision. It can be wrong, incomplete, or unsuitable for your team.
Do not: use the Service unlawfully or to harass anyone; upload information about athletes you have no standing to enter; attempt to access another coach’s or parent’s data; probe, scan, or interfere with the Service or its security controls; scrape or bulk-extract data; resell or white-label the Service without our written agreement; or use it to build a competing product.
Good-faith security research is welcome. Report findings to coach@diamondcoach.app before disclosing them anywhere else, and do not access data that is not yours.
The Service is currently offered free of charge. We may introduce paid plans in the future. If we do:
Where paid plans exist, fees, billing cycle, and refund terms will be stated at the point of purchase and form part of these Terms.
We aim for the Service to be available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features. If we discontinue the Service entirely, we will give reasonable notice and a way to export your data.
You may delete your account at any time from inside the Service; deletion is permanent. We may suspend or terminate an account that breaches these Terms, that puts athlete information at risk, or where required by law. Sections 3, 9, 10, 11, and 13 survive termination.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KANE PC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
Some jurisdictions do not allow certain limitations; in those places these limits apply only to the extent permitted.
You will indemnify and hold harmless Kane PC from claims arising out of your use of the Service, your breach of these Terms, or your entry of athlete information without the authority to do so.
We may update these Terms. We will change the date above and, for material changes, notify account holders by email. Continued use after a change means acceptance.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Westchester County, New York, and you consent to their jurisdiction.
